I understand that “Remembering Kenny” is a self-defense system where physical confrontation is addressed in a “hands on” manner. I further understand that I will be involving myself in the activities of this class and by doing so I may be susceptible to bodily injury and/or property damage.
By signing this Waiver of Liability, I acknowledge my understanding that these activities that I am freely and voluntarily involving myself in are inherently dangerous and involve the risk of serious bodily injury and/or property damage. I also understand that any injury that I may receive may be compounded or increased by negligent operation or procedures of other participants involved in the class.
I expressly agree to assume full responsibility for any risk of bodily injury and/or property damage arising out of, or related to, my participation in and/or my observance of the “Remembering Kenny” activities, whether caused by the negligence of the systems participants, observers, or otherwise. I fully release the instructor (Richard Whirley), his members, participants, observers, owners and/or administrators of land upon which “Remembering Kenny” activities may be held, and/or emergency medical personnel from any and all liability to myself, my assigns, heirs and next of kin for any loss or damage on account of injury to myself or my property arising out of my own negligence, the negligence of other “Remembering Kenny” participants or observers, or otherwise.
I expressly agree that if at any time I feel any “Remembering Kenny” activity to be unsafe, or if I observe unsafe behavior on the part of other participant(s), I will immediately advise the instructor or other “Remembering Kenny” official(s) of such observation and/or refuse to participate further in the activity. I also understand that the instructor reserves the right to deny teaching to anyone whom he finds disruptive or unruly for any reason and that I will be forced to leave with no questions asked if the instructor so decides. I also understand that in this situation (as well as any other), I will not be reimbursed or given even a partial refund.
I UNDERSTAND THAT BY SIGNING THIS AGREEMENT I HAVE GIVEN UP SUBSTANTIAL LEGAL RIGHTS. I HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. I HAVE READ THIS WAIVER OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I AM AT LEAST EIGHTEEN (18) YEARS OF AGE.
